Terms of Service
1.) Account Setup HostHongKong.net
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) incase of fraud.
Shared and Reseller Hosting Accounts
It is your responsibility to provide us with an email address, which is not @ the domain(s) you are signing up under. Our normal setup time for shared/reseller hosting accounts are instant upon payment verification.
VPS, Dedicated and Colocation Server Accounts
VPS and Dedicated servers carry a 3-day setup time unless stated otherwise.
For colocation servers, once payment has been arranged, either a move in date will be provided for the server to be brought in, or a postal address will be provided so Host Hong Kong can setup your server for you.
2.) Content
All services provided by HostHongKong.net may only be used for lawful purposes. This includes, but not limited to; copyrighted material, material we judge to be threatening or obscene. The customer agrees to indemnify and hold harmless HostHongKong.net from any claims resulting from the use of our services. Host Hong Kong is a lawful web-hosting company of which Hong Kong law is recognized.
Examples of unacceptable material:
- Copyright / Pirated Software
- Hate / Racist / Discriminating sites
- Child Pornography
3.) Zero Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, commonly known as spam. Any user who sends out spam will have their account terminated without notice.
HostHongKong.net reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. HostHongKong.net also reserves the right to make any such modifications in an emergency at our sole discretion.
HostHongKong.net reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of HostHongKong.net. All rights reserved.
4.) Payment Information
You agree to supply appropriate payment for the services received from HostHongKong.net, in advance of the time period during which such services are provided. You agree that until and unless you notify HostHongKong.net of your desire to cancel any or all services received, those services will be billed on a recurring basis.
HostHongKong.net reserves the right to change the monthly payment amount and any other charges at anytime. A one-month notice period will be given before any changes of pricing will take affect. Contracted services will continue at the agreed rate until the end of the term.
5.) Backups and Data Loss
Your use of the service is at your sole risk. HostHongKong.net is not responsible for files and data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backups of files and data stored on HostHongKong.net servers.
6.) Cancellation, Refunds and Money Back Guarantee
HostHongKong.net reserves the right to cancel the account at any time. Customers may cancel at any time.
Shared and Reseller Hosting Accounts
HostHongKong.net provides a conditional 14-day money back guarantee on managed shared hosting, and reseller solutions. Refund requests after 14 days will not be negotiated.
Accounts cancelled/terminated by HostHongKong.net do not qualify for the 14-day money back guarantee. Only first-time accounts are eligible for a refund. For example, if you've had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.
VPS, Dedicated and Colocation Server Accounts
VPS, Dedicated and Colocation servers are non refundable once service has begun.
7.) Resource Usage
Shared and Reseller Hosting Accounts
Users may not initiate the following:
- Run any process that requires more than 8Mb of memory space, more than 30 CPU seconds, or use more than 5% of all available system resources at any time.
- Run any type of interactive real-time chat applications that require server resources. Remotely hosted services are fully allowed.
- Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
- Run any software that interfaces with an IRC (Internet Relay Chat) network.
- Run any gaming servers such as counter-strike, half-life, battlefield1492, etc
8.) Bandwidth Usage and Fair Usage Policy
Shared and Reseller Hosting Accounts
Reseller hosting and some shared hosting packages are are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account reach or exceed the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.
Shared hosting services with unlimited bandwidth are subject to a fair usage policy. Host Hong Kong reserves the right to implement a speed cap, suspend services or restrict access upon the following conditions.
- File downloads (mp3, avi, move etc.)exceeding 100GB traffic in a single month.
- Affecting network or server performance.
This fair usage policy is intended to ensure that services provided to all clients recieve the same high standard that is expected. Restrictions are rarley implemented and action is only taken as a last resort.
VPS, Dedicated and Colocation Server Accounts
Services operating on shared bandwith are limited to our fair usage policy. Host Hong Kong reserves the right to implement a speed cap, or disconnect services upon the following conditions.
- Local (HK) traffic exceeding 500GB in a single month.
- International/Overseas traffic exceeding 100GB in a single month.
- Affecting network performance for other servers connected to the network.
- Using over 3mbit for an extended duration.
This fair usage policy is intended to ensure that services provided to all clients recieve the same high standard that is expected. Restrictions are rarley implemented and action is only taken as a last resort.
9.) Price Change
HostHongKong.net reserves the right to change the price of any services at any time with a 30 days notice to the current customers. Contract pricing customers will not be affected by any price change throughout the contract period.
10.) Indemnification
Customer agrees that it shall defend, indemnify, save and hold HostHongKong.net harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against HostHongKong.net, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless HostHongKong.net against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with HostHongKong.net; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from HostHongKong.net's servers.
11.) Disclaimer
HostHongKong.net will not be responsible for any damages your business may suffer. HostHongKong.net makes no warranties of any kind, expressed or implied for services we provide. HostHongKong.net disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by HostHongKong.net and its employees.
12.) Changes to the TOS
HostHongKong.net reserves the right to revise its policies at any time without notice.
